1. Scope of use
You may view the Dataset solely for informational or research purposes, within the scope, context, and intended purpose described on this site. Any application, adaptation, testing, or implementation of the HerNest methodology or derived insights for commercial, institutional, clinical, legal, or regulatory decisions requires a formal license and/or supervised engagement with HerNest.
2. No Warranty
HerNest provides the Dataset and related insights “as is” without warranty of any kind. HerNest expressly disclaims all warranties, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, completeness, and non-infringement.
3. Limitation of Liability.
To the fullest extent permitted by law, HerNest shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your access to or use of the Dataset, including any DIY application of methodology or decisions made on the basis of the Dataset without consulting a licensed Implementation Partner.
4. Indemnification.
You agree to indemnify, defend and hold harmless HerNest and its affiliates, officers, employees and agents from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or resulting from your use of the Dataset, your breach of this Attestation, or your unauthorized deployment of HerNest methodology.
5. License & Contact Requirement.
If you intend to implement or apply any part of the HerNest methodology (including for business purposes, product development, training, or public use), you must contact HerNest to obtain a license or contact a Licensed Implementation Partner. Use of the methodology in any implementation without an explicit license or guidance can not hold Hernest Liable.
6. Data Integrity & Non-Manipulation.
You may not reproduce, publish, repurpose, or redistribute the Dataset or derived materials in any way that interferes with or materially alters HerNest’s ongoing data integrity work. You agree not to use the Dataset for influencing tracked populations or creating public campaigns that would contaminate HerNest observations.
7. Reporting & Feedback.
If you identify errors, vulnerabilities, or significant adverse outcomes attributable to the Dataset, you must promptly report them to HerNest (info@hernest.africa) and suspend any further implementation until HerNest has reviewed.
8. Consent to Contact & Logging.
By accepting, you authorize HerNest to collect and retain your name, email, organization, IP address, device, session timestamps, and any notes you provide. HerNest may use these details to follow up regarding licensing, training, and support. HerNest may also share anonymized usage metrics for internal testing and reporting.
9. Duration & Revocation.
HerNest may revoke your access at any time, for any reason, including suspected misuse. Continued access after notice of revocation is a breach of this Attestation.
10. Governing Law.
These terms are governed by the laws of the Federal Republic of Nigeria, and any disputes will be resolved in the appropriate courts of that jurisdiction.
